Several Forms Of Bill Of Lading Pfer
The form of bill of lading can be pferred or circulated through the bill of lading, so that the sale and pfer of goods on it can be realized and the ownership of the goods will be pferred. According to the contents of the "consignee" column, the bill of lading can be divided into straight bills of lading, instructions B / L and bearer bill of lading. The three bills of lading follow different pfer rules.
The seventy-ninth clause of the Maritime Code of China stipulates three cases of the pfer of bill of lading: "the pfer of bill of lading shall be carried out in accordance with the following provisions:
(1) a straight bill of lading shall not be pferred; (two) a bill of lading is instructed to be pferred by endorsement or endorsement in blank; (three) an unnamed bill of lading can be pferred without endorsement. "
The core role of the bill of lading is to replace the marine cargo, the pfer of the bill of lading, that is, the pfer of the rights recognized in the bill of lading. According to the above provisions, the bill of lading is divided into two types: pferable and non pferable. Straight bills of lading are not pferable, indicating that bills of lading and bearer bill of lading can be pferred. Generally speaking, the pfer of bills of lading is inseparable from two links: endorsement and delivery. Accordingly, the pfer of bills of lading can be divided into two cases: Endorsement plus delivery and pfer without endorsement. The meaning of delivery is clear, that is, the pfer and possession of bills of lading.
It is indicated that the bill of lading is endorsed and delivered, and that the bearer bill of lading is delivered or pferred without any legal effect. The original meaning of the endorsement is "on the back", and then refers to the behavior of the holder of the document writing on the back of the document. The endorsement of bill of lading has no legal definition, but its meaning generally refers to the description of the bill of lading on the back of the bill of lading and the signature of which person to make the goods.
