Model Contract For Domestic Tourism Group (Trial) (1)

Contract No.: Party A: (tourist or unit) Domicile or company address: Telephone: Party B: (group travel agency) Address: Telephone:    After equal negotiation, Party A and Party B voluntarily signed the following contract on matters related to Party B's participation in the tour organized by Party A: Article 1 [Tourism content] The number of the tour group is: Tourist routes: The departure time of the tour group is MM DD YY, and the end time is MM DD YY, totaling days and nights. The tourist routes and itinerary listed in the preceding paragraph are detailed in the Tourism Schedule. The Travel Schedule is signed by both parties as an integral part of this contract. Article 2 [Service Standards] The service quality of the tour group shall be in accordance with the "Service Quality of Domestic Tourism of Travel Agencies" standard issued and implemented by the National Tourism Administration (or agreed by Party A and Party B). Article 3 [Travel expenses] The total travel expenses of the tour group is RMB. On the date of signing this contract, Party A shall prepay RMB, and the balance shall be paid the day before departure. Article 4 [Project expenses] The travel expenses paid by Party A according to Article 3 of this contract include the following items: 1. Service charge for handling documents on behalf of Party A: service charge for handling travel documents on behalf of Party B. 2. Transportation ticket fee: the fee for Party B to purchase transportation tickets from civil aviation, railway, long-distance passenger transport companies, water transport and other public transport departments on behalf of Party A. 3. Catering and accommodation expenses: Catering and accommodation expenses listed in the Travel Schedule that shall be arranged by Party B. 4. Tour fee: the tour fee listed in the "Tour Schedule" that should be arranged by Party B, including the transportation fee from the accommodation to the tour place, and the first ticket fee of the tourism project that non tourists pay separately. 5. Transfer fee: transfer fee from airport, port, station, etc. to hotel during travel. 6. Tourism service fee: the fee charged by Party B for providing various tourism services (including tour guide service fee). 7. Other expenses agreed by both parties: If the government adjusts the fare for the transportation ticket in Item 2 of the preceding paragraph, the refund or supplement of the fare shall be handled in accordance with Article 63 of the Contract Law. For the catering and accommodation expenses in Item 3, if Party A requires to raise the standard and Party B agrees to arrange, Party A shall make up the difference. Article 5 [Non project expenses] The travel expenses paid by Party A according to Article 3 of this contract do not include the following items: 1. Airport construction fees at various places. 2. Party A's personal expenses incurred during the journey: such as personal catering expenses on transportation vehicles; Medical expenses for personal injuries and diseases; Excess baggage charges; Expenses for laundry, telephone, telegram, drinks and alcohol during travel and accommodation; Private transportation fees; Free activity expenses; Expenses and rewards for recovering personal lost articles, and compensation expenses caused by personal behaviors during the journey. 3. Insurance premiums self insured by Party A: aviation personal accident insurance premiums and other insurance premiums self insured by Party A. 4. The tour fees agreed by both parties and separately paid by Party A at its own choice. 5. Other expenses not listed in Article 4. Article 6 [Departure time and place] Party A shall assemble and depart on time at (place) on (date). If Party A fails to arrive at the agreed place on time to assemble and set out, and fails to join the tour group halfway, it shall be deemed that Party A terminates the contract, and Party B may claim compensation in accordance with Article 8 of this contract. Article 7 [Number of people agreed] This tour group can only be formed if there are more than one signatories. If the number of people is not reached, Party B may terminate the contract by giving a notice to Party A days (not less than 5 days) before the agreed departure date. After Party B terminates the contract, it shall be handled in one of the following ways: 1. Party B shall not be liable for Party A's breach of contract by returning all fees paid by Party A. 2. Party B shall return or Party A shall make up for any increase or decrease in the cost of another travel contract. If Party B fails to notify Party A at the agreed time, it shall compensate Party A in accordance with Article 9 hereof. The telephone or fax provided by Party A must be frequently used or can be contacted in a timely manner. Otherwise, if Party B needs to notify Party A in this article and other articles but fails to notify Party A, it will not be liable for compensation arising therefrom. Article 8 [Party A withdraws from the group] Party A may notify Party B to terminate this contract before the start of tourism activities, but must bear the necessary expenses that Party B has already paid for this tourism, and pay liquidated damages according to the following standards: 1. If it is notified 5 days before the start of the tour, it shall pay 10% of the balance of all travel expenses after deducting the necessary expenses that Party B has already paid. 2. If the notice is received from the 5th to the 3rd day before the start of travel, 20% of the balance of all travel expenses shall be paid after deducting the necessary expenses already paid by Party B. 3. If the notice is received from the third day to the first day before the start of travel, 30% of the balance of all travel expenses shall be paid after deducting the necessary expenses already paid by Party B. 4. If the notice is given one day before the start of the tour, 50% of the balance of all travel expenses shall be paid after deducting the necessary expenses already paid by Party B. 5. If notice is given or no notice is given on or after the start of the tour, 100% of the balance of all travel expenses less the necessary expenses already paid by Party B. Article 9 [Cancellation by Party B] Except for the circumstances stipulated in Article 7 of this contract, if Party A's tourism activities cannot be carried out due to Party B's reasons and are cancelled, Party B shall immediately notify Party A and pay liquidated damages according to the following standards: 1. 10% of all travel expenses will be paid if the notice is received 5 days before the start of the tour. 2. 20% of all travel expenses will be paid if the notice is received from the 5th to the 3rd day before the start of travel. 3. 30% of all travel expenses will be paid if the notice is received from the 3rd to the 1st day before the start of travel. 4. 50% of all travel expenses will be paid if the notice is given one day before the travel starts. 5. 100% of all travel expenses will be paid if the notice is given on or after the travel start date. Article 10 [Contract Transfer] With the consent of Party B, Party A may transfer its rights and obligations under this travel contract to a third person who has the conditions to participate in this travel, but shall notify Party B days before the agreed departure date. Party A shall bear any increase in expenses.
