Since the first criminal law of new China was formulated in 1979, the criminal law has been in the process of continuous revision.

In 1980, the criminal law came into operation, and in 1981, the first revised legal document was made. After 1996, the criminal law was formulated 17 years later, there were 24 additional amendments to the criminal law or supplementary provisions. The fifth session of the Eighth National People's Congress in 1997 was a comprehensive revision of the criminal law. After that, the Standing Committee of the National People's Congress amended the criminal law successively through a decision and 7 amendments.

At the sixteen session of the Standing Committee of the eleven National People's Congress in August this year, the draft amendment to the criminal law (eight) was first submitted for deliberation.
