Since the public solicitation of opinions, the pace of legislation has been running rapidly.
In December 15th, the full text of the legal office of the State Council published the "Regulations on housing expropriation and compensation on state owned land (the second public solicitation draft)" and its explanation, and consulted the views of all walks of life again.
The new version of the Ordinance has made breakthrough progress in the aspects of relocation compensation, public interest definition, collection procedures and forced relocation. The abolition of administrative demolitions is clearly decided by the court. It is clear that the housing levy announcement should include a compensation scheme, and its compensation standard must not be lower than the market price.
Comment:
The second public consultation has been made without precedent. The formulation of the new demolition Ordinance is preceded by the administrative regulations of the State Council.
Since the drafting and study of the bill in 2007, 43 seminars, demonstration sessions and more than 1070 people participated in the discussions.
More than 7500 written comments were received by soliciting opinions or written investigations.
Among them, after the public consultation in January 29th, there were 27 seminars and more than 760 demonstration sessions.
The data fully show that "this regulation is very important," so the framers should be more cautious.
