The Ministry of human resources and social security has recently promulgated the "Regulations on the negotiation and mediation of labor disputes in enterprises" and will come into force on January 1, 2012.

The provisions clearly stipulate that large and medium-sized enterprises shall set up a labor dispute mediation committee according to law, with branches, branches and branches.

The relevant departments of the Ministry of human resources and social security said that at present, labor disputes in China's enterprises, especially non-public enterprises, are prone to occur frequently, and labor disputes are at a high level.

The release of the provisions on the negotiation and mediation of labor disputes in enterprises is to implement the "labor dispute mediation and Arbitration Law of the People's Republic of China", and promote enterprises to establish and improve mediation organizations, establish preventive work mechanism, and perfect mediation system.

According to the introduction, the provisions are divided into 4 parts: General principles, consultations, conciliation and annexes. The contents include establishing the mechanism of communication and consultation between employers and employees within the enterprise, strengthening the construction of the labor dispute mediation committee of enterprises, establishing a preventive work mechanism, establishing an arbitration review and confirmation system for labor dispute mediation agreements, and giving full play to the role of the three party principle of labor relations.
