The regulations for the implementation of the patent law of the People's Republic of China stipulate that the fees for applying for patent include: application fee, application fee, application fee and printing fee; two, invention patent application, substantive examination fee, reexamination fee, three, patent registration fee, announcement fee, printing fee, application maintenance fee, annual fee, four, cataloguing alteration fee, priority claim fee, restoration right claim fee, extension period request fee, utility model patent search fee, five, invalidation claim fee, stop procedure request fee, compulsory license request fee and compulsory license fee.

The way of paying the above fees can be paid directly to the Patent Administration Department of the State Council, or by mail.

If a remittance is paid through a post office or a bank, the correct application number or patent number and the name of the fee should be written on the remittance slip sent to the patent administration department under the State Council. If it fails to comply with the regulations, it shall be deemed to have not paid the formalities for payment.

The payment is made directly to the Patent Administration Office of the State Council at the time of payment.

If the payment is made by post office or bank remittance, the postage date of the post office or the actual remittance date of the bank shall be the payment date; however, from the date of the remittance date to the day when the Patent Administration Department of the State Council receives more than fifteen days, except for the certificate issued by the post office or the bank, the date of receipt by the Patent Administration Department of the State Council is the payment date.

The applicant shall apply for refund to the Patent Administration Department of the State Council within one year from the date of payment from the date of payment, whether for reasons such as overdue payment, repaid or wrongly paid royalty.
