9, Party A and vehicle manufacturers should ensure the safety of vehicles under normal driving conditions without any hidden danger. The product manuals or product user's books should give a detailed description of the safety operation methods, the time and safety of the safety devices, and give clear instructions to Party B.

The seller and the manufacturer shall ensure that all the safety devices specified in the product specification or product use book are in effective use during the validity period of the vehicle.

10, after purchasing, the buyer is responsible for contacting and solving the special repair station of the manufacturer, but Party A shall provide convenience for liaison, communication and assistance.

Party A and vehicle manufacturers should set up a certain number of special repair stations, and ensure that vehicles can be repaired in time, with sufficient auto parts and reasonable charges.

Seven, liability for breach of contract: 1, any party violating this contract, including, but not limited to, Party A's failure to deliver the vehicle according to the terms of this contract, or delivery of the vehicle quality which is not in accordance with the conditions of this contract, or the potential concealed defect of the vehicle can not be inspected at the time of pfer; Party B fails to pay the vehicle in accordance with the provisions of this contract; does not cooperate with the other party in handling vehicle loans, insurance and licensing; any party who violates the warranty or commitment clause or fails to perform the obligation of cooperation and causes the other party to fail to achieve the purpose of the contract shall bear the responsibility for breach of contract.

The compliance party is required to reduce the price, repair it free of charge (within seven days of repair), pay the penalty for breach of contract (calculated on the basis of 5 per cent of the total vehicle price per Chi Yanyi day), change the contract, continue to perform the contract, and terminate the rights of the contract. The above rights can be reasonably chosen by the observing party under different circumstances.

2, if it is a quality problem (including appearance) that occurs before the delivery of the vehicle, Party A has not expressly indicated to Party B that Party B has the right to investigate Party A's liability for breach of contract in accordance with the preceding paragraph of this article.

However, Party A has evidence that there is no fault in the quality issue. If Party A is unaware, Party A may be exempted from liability.

Although Party A has handed in the car to Party B, Party A shall repair the vehicle in time in accordance with the fifth provision of this contract. If the vehicle is damaged on the card and the insurance agency, Party A shall repair it free of charge in time, and Party B has the right to request Party A to reduce the vehicle price or compensate the loss appropriately.

The main parts and systems of the vehicle such as engine, circuit system, oil circuit system, brake system and direction system are malfunctioning and can not be repaired after 2 repairs in 1 years. And Party A conceals the real condition of the vehicle, Party A shall bear the corresponding legal liability.

If the situation is serious, Party B can terminate this contract.

Party A can provide damages to the vehicle due to the quality problems of various parts, and affect the normal use of Party B. Party B can claim damages from Party A. the problem can seriously cause the vehicle to be unable to run normally, and Party A can conceal the real condition of the vehicle. Party B can request the rescission of the contract.

Eight dispute resolution: any dispute arising from or in connection with this contract shall be settled through negotiation between the two parties. If the negotiation fails, either party can take the following measures to settle the matter: 1, to lodge a lawsuit against the court of the place where the party is located; 2, to bring a lawsuit to the court where Party B is located; 3, to submit an arbitration to the Shanghai branch of the China International Economic and Trade Arbitration Commission.

4, apply for arbitration to the Shanghai Arbitration Commission.

Nine, contract text: this contract is distributed in one copy, each side holds two copies.

Ten, the validity of the contract: the contract shall be legally valid after signing or sealing by Party A and Party B, but if Party B buys the vehicle mortgage loan, the two parties agree to choose the following method: (1) if the bank agrees to the mortgage loan of Party B, the contract will become effective; otherwise, the contract will not take effect.

(2) no matter whether the bank agrees to mortgage loan, this contract is valid. Instead, Party B pays the full vehicle payment to Party A, but Party A agrees to give a grace period, and B pays to Party A in installments. The payment method and time limit are: eleven, other terms and conditions. The appendix or supplementary agreement of this contract has the same legal effect as this contract.
