一、貿(mào)易救濟措施

(1) Peru levying provisional anti-dumping duties on imported Chinese shoes.

In March 2, 2009, the Peru state monopoly and protection intellectual property Bureau Commission on dumping and subsidies released the No.033-2009/CFD-INDECOPI resolution, deciding that the price of CIF imported from China is less than or equal to 5.97 US dollars / pairs, and the provisional anti-dumping duty is 0.31 USD / double with casual shoes and sports shoes made of textile materials as upper surfaces.

In 2008, China exported 7 million 740 thousand pairs of shoes to Peru, amounting to more than 38 million US dollars, up 67% and 83% respectively over 2007.

(2) Argentina launched anti-dumping investigations on China's footwear products.

According to the 42 resolution issued by the State Secretariat of industry, trade and small and medium-sized enterprises in February 26, 2009, the Arab side launched anti-dumping investigations on shoes originating in China, the Deputy State Secretariat of trade management and policy of the Ministry of production of Argentina said.

Specific information for the investigation: male, female and children's daily, social or sports use, natural and / or synthetic shoe upper and outsole boots, excluding orthopaedic shoes outside the common market's tax code 6401-6405, and ice skating and ski practice shoes with Mercosur market tax numbers 6402.12 and 6403.12.

Footwear exported to Argentina was exported to 11 million pairs in 2008, with an amount of US $about 72000000, an increase of 33% and 45% respectively over 2007.

(3) Canada conducts anti-dumping investigations on plastic footwear products made in China.

In February 27, 2009, the Canadian Border Services Department launched an anti-dumping investigation on the export of waterproof plastic shoes (6401 tax items).

In 2008, China exported more than 146 pairs of products to Canada under 6401 items, involving 8 million US dollars, representing an increase of 91% and 126% respectively compared with 2007.

(4) Brazil launched an anti-dumping investigation on my footwear products.

In January 5, 2009, the Trade Protection Bureau (DECOM) of the Brazil development industry Trade Secretariat sent a letter to my Embassy in Brazil, which informed the Brazil Footwear Association (ABICALCADOS) that it had decided to conduct anti-dumping investigations on footwear products from China. The shoes with the tax code of 6402 to 6405 were numbered 6402.12.00 and 6402.20.006403.12.00 and 6403.20.00 were not included in the anti-dumping investigation.

The investigation period was 1~12 31 January 2007. Brazil chose Italy as an alternative country.

In 2007, 26 million 380 thousand pairs of footwear products exported to Brazil amounted to US $110 million, representing an increase of 38.8% and 55% respectively. In 2008, the increase in exports to Brazil dropped by nearly 50%, and exports amounted to nearly 30 million pairs, with a sum of 130 million US dollars.

The EU forbids the import of leather products containing two methyl fumarate.

In January 29, 2009, EU Member States adopted the draft resolution to ensure that consumer products containing two methyl fumarate will not be put into the European market.

The law prohibits the import and marketing of seats and footwear products containing two methyl fumarate.

Fumaric acid two methyl ester is a biocide that inhibits mold. This mold can cause deterioration of leather furniture or footwear products during wet storage or pportation.

Fumaric acid two methyl ester penetrates the skin of consumers through clothing, causing skin contact dermatitis pain, including itching, irritation, redness and burns; in some cases, acute respiratory disease has also been reported.

(1) the EU's anti-dumping duties on Chinese leather shoes continue to be indefinite.

In early March, the China Leather Association jointly organized the Chinese delegation to Brussels to participate in the second hearing of the European Commission's anti-dumping review of China's leather shoes exports, which further demonstrated the attitude of the Chinese government and footwear industry to the case and conveyed the voice of the Chinese footwear industry to the European Commission.

      這次反傾銷聽證會是歐盟皮鞋反傾銷日落復(fù)審的關(guān)鍵程序，中方做了大量的準備工作，為律師提供了詳細的中國鞋類市場銷售和出口數(shù)據(jù)，希望能盡力爭取到一個有利于中方的結(jié)果。 但由于近期拉美國家對中國鞋類反傾銷頻繁發(fā)生，使此案件結(jié)案的不確定因素增多。

(2) perfluorooctane sulfonate may be included in the controlled range of the Stockholm convention.

Perfluorooctane sulfonate (PFOS) has both hydrophobic and hydrophobic properties. It has been used to produce antifouling agents such as textiles, leather products, furniture and carpets. Because of its very stable chemical properties, perfluorooctane sulfonate is used as an intermediate for the production of paints, foam extinguishing agents, flooring agents, pesticides and termite agents.

PFOS, as a persistent organic pollutant, has been proved to be toxic, bioaccumulative and difficult to degrade, and can be pported and deposited in other areas far away from other sewage points through air, water and migratory species and products, which has posed a threat to ecological safety.

Earlier, Australia, Canada, the European Union, the United States and other countries have put forward many restrictive measures to PFOS.
