The EU anti-dumping lawsuit against China's leather shoes involving US $700 million US dollars has not been concluded with the EU's recent "sunset review", that is, the administrative review after the expiration of the anti-dumping duty on products.

The Ministry of Commerce of China attaches great importance to this lawsuit, and appealed to shoe manufacturers to go all out to review the sunset at the three shoe making bases in Zhejiang, Guangdong and Fujian, and strive to cancel the 16.5% anti-dumping duty.

Following the 8 European Union anti-dumping action against Chinese leather shoes in Wenzhou, Zhejiang, the Ministry of Commerce convened a meeting of Guangdong shoe manufacturers in Zhongshan, Guangdong yesterday. It will hold another mobilization shoe enterprise in Fujian Quanzhou today to actively respond to the meeting.

Guo Weiwen, Secretary General of the European Union's anti dumping alliance with Chinese shoes products and Guangdong Wan Bang shoe company spokesman, told the first Financial Daily yesterday that Guangdong shoe enterprises are preparing materials for reexamination, but it is difficult to judge the final outcome of the lawsuit, but will try to win the lawsuit.

The purpose of this response is to "completely abolish the anti-dumping duty" and "fight the defense without damage" as a foothold.

The sampling procedures were taken by the investigation authorities, and the sampling tables were submitted by the enterprises involved before 20 days of this month. In early November, the European Commission will announce the sampling enterprises, and the enterprises being extracted will enter the written defense procedure, which will last 37 days.

A few days ago, Guangdong shoe enterprises have formed an alliance of enterprises. Most footwear enterprises in Wenzhou are actively preparing for sampling materials under the appeal of Wenzhou shoe leather industry association.

Participating in the Ministry of Commerce, the Zhejiang provincial foreign trade and Economic Cooperation Department, the China Light Industry Arts and crafts import and Export Chamber of Commerce, the China Leather Association and the Wenzhou shoe leather industry association, the AOKANG group told reporters that they were prepared to carry out two line operations. On the one hand, in 2006, five Chinese shoe companies such as AOKANG filed anti-dumping proceedings against the European Court of justice. After two years of written defense by the court, the oral defense procedure will be held at the end of this year or early next year. On the other hand, AOKANG and other famous enterprises in Wenzhou are actively preparing to sample the materials and unite with other domestic shoe enterprises to collectively respond to the "sunset review".

AOKANG's lawsuit against the European Union's attorney is also the Chinese lawyer's main representative, sun Ling, who will review the sunset at the same time.

If the collective protest is successful and the anti-dumping duty is abolished, AOKANG and other shoe enterprises can continue to file a lawsuit with the European Union so that the European Union can make an apology or withdraw the lawsuit. If the worst intention is to make the collective failure to respond, then the lawsuit between AOKANG and other European Union courts can continue to fight for market economy status.

In October 23, 2006, AOKANG group formally decided to initiate a lawsuit against the first instance court of the European Union, accusing the European Council of imposing a 16.5% anti-dumping duty not in conformity with the relevant laws of the European Union.

Subsequently, 4 enterprises such as Wenzhou Tamar, Guangdong new born Hong Kong dollar, Guangdong Nanhai golden shoe and Guangdong Wan Bang were followed up and appealed jointly.

The EU's anti-dumping measures against Chinese leather shoes for two years have expired on the 6 th of this month.

However, the European Commission recently announced that it will conduct "sunset review" on anti-dumping measures for leather shoes in China and Vietnam.

According to the relevant investigation procedures, the time spent usually takes 12 months to 15 months, which means that the EU anti-dumping duties on Chinese leather shoes and children's shoes will be extended for another 12 to 15 months.

China's Ministry of Commerce issued a statement on 3 July, saying that China regretted the EU's anti-dumping investigation on Chinese leather shoes "sunset review". The Chinese government opposes the European side's extension of the measures in any form.
